⚠️ This is a template. Replace the bracketed placeholders and have a lawyer licensed in your jurisdiction review it before launch. Random video chat is a heavily regulated category (UK Online Safety Act, EU DSA, US state age-verification laws) and this template alone does not make the service compliant.
Larp Battle ("the Service") is operated by [COMPANY NAME], [COMPANY ADDRESS] ("we", "us"). Contact: [CONTACT EMAIL].
The Service randomly pairs you with another user for a live one-to-one video "flex battle." During a battle, still images ("Frames") are captured from your camera at approximately one-second intervals and analyzed by third-party artificial-intelligence services to (a) identify and estimate the value of items you choose to show, and (b) screen for prohibited content. An AI-generated verdict declares a winner. The Service also displays the approximate country of each participant, derived from their IP address.
By starting a battle you expressly consent to:
Do not show anything on camera you do not want captured and analyzed. Do not show other people who have not consented.
Item identifications, authenticity assessments, valuations, and battle verdicts are generated by AI and are estimates for entertainment purposes only. They are not professional appraisals, financial advice, or statements of fact, and may be wrong. We accept no liability for decisions made in reliance on them. The Service involves no wagering, prizes, or monetary stakes.
You must not:
Video and audio travel directly between you and your opponent (or via a relay server when a direct connection is impossible). We do not view, record, or store your live video stream itself; only the sampled Frames described above reach our servers. Other users are strangers: we do not verify their identity, and you interact with them at your own risk. Your IP address may be technically visible to your peer as an inherent property of peer-to-peer connections.
You retain rights to your Frames. You grant us a worldwide, non-exclusive, royalty-free license to process, store, and reproduce Frames solely to operate the Service (judging, moderation, abuse investigation, legal compliance).
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR THE CONDUCT OF OTHER USERS, FOR AI OUTPUT, AND FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED [USD 100] OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain exclusions; those limits apply only to the extent permitted by law.
We may suspend or terminate your access at any time, with or without cause or notice. Sections 5, 7, 9, 10, 12, and 13 survive termination.
These Terms are governed by the laws of [JURISDICTION]. Disputes shall be resolved in the courts of [VENUE] [or by binding arbitration under [RULES] — choose one with counsel; arbitration clauses and class-action waivers have jurisdiction-specific requirements].
We may update these Terms. Material changes will be announced on the Service. Continued use after changes take effect constitutes acceptance.
