Terms & Conditions

⚠️ This is a template. Replace the bracketed placeholders and have a lawyer licensed in your jurisdiction review it before launch. Random video chat is a heavily regulated category (UK Online Safety Act, EU DSA, US state age-verification laws) and this template alone does not make the service compliant.

1. Who we are

Larp Battle ("the Service") is operated by [COMPANY NAME], [COMPANY ADDRESS] ("we", "us"). Contact: [CONTACT EMAIL].

2. What the Service is

The Service randomly pairs you with another user for a live one-to-one video "flex battle." During a battle, still images ("Frames") are captured from your camera at approximately one-second intervals and analyzed by third-party artificial-intelligence services to (a) identify and estimate the value of items you choose to show, and (b) screen for prohibited content. An AI-generated verdict declares a winner. The Service also displays the approximate country of each participant, derived from their IP address.

3. Eligibility — 18+

  • You must be at least 18 years old (or the age of majority where you live, if higher) to use the Service.
  • You must not use the Service if you have previously been banned.
  • We may deploy age-assurance measures and may refuse, suspend, or terminate access at our discretion.

4. Your consent to capture and AI analysis

By starting a battle you expressly consent to:

  • Capture of Frames from your camera approximately every second while a battle is live;
  • Transmission of those Frames to our servers and to third-party AI providers (currently OpenAI) for item identification, valuation, and content moderation;
  • Your live video and audio being transmitted directly (peer-to-peer) to the stranger you are matched with;
  • Display of your approximate country (derived from your IP address) to your opponent.

Do not show anything on camera you do not want captured and analyzed. Do not show other people who have not consented.

5. AI verdicts are entertainment, not appraisals

Item identifications, authenticity assessments, valuations, and battle verdicts are generated by AI and are estimates for entertainment purposes only. They are not professional appraisals, financial advice, or statements of fact, and may be wrong. We accept no liability for decisions made in reliance on them. The Service involves no wagering, prizes, or monetary stakes.

6. Prohibited conduct

You must not:

  • Appear on camera nude or engage in sexual conduct, or expose others to it;
  • Use the Service if you are under 18, or interact with anyone you believe is under 18 (report them immediately);
  • Harass, threaten, defame, or discriminate against other users;
  • Show or promote illegal goods, weapons, drugs, or stolen property;
  • Record other users without their consent, or attempt to identify, stalk, or locate them;
  • Misrepresent stolen or counterfeit goods as your property (showing replicas as part of the game is permitted — the judge scores them accordingly);
  • Attempt to circumvent bans, moderation, frame capture, or rate limits, or probe or disrupt the Service;
  • Use the Service for commercial solicitation, spam, or data harvesting.

7. Moderation, reports, and bans

  • Frames are automatically screened. Battles may be terminated and users banned automatically or by human review, with or without notice.
  • When a user is reported, Frames and metadata from the reported battle are preserved as evidence (see the Privacy Policy).
  • We report apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement as required by law.
  • Bans may be enforced by IP address, device, or other identifiers. We are not obliged to disclose our moderation methods.

8. Peer-to-peer video and other users

Video and audio travel directly between you and your opponent (or via a relay server when a direct connection is impossible). We do not view, record, or store your live video stream itself; only the sampled Frames described above reach our servers. Other users are strangers: we do not verify their identity, and you interact with them at your own risk. Your IP address may be technically visible to your peer as an inherent property of peer-to-peer connections.

9. Intellectual property

You retain rights to your Frames. You grant us a worldwide, non-exclusive, royalty-free license to process, store, and reproduce Frames solely to operate the Service (judging, moderation, abuse investigation, legal compliance).

10. Disclaimers and limitation of liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR THE CONDUCT OF OTHER USERS, FOR AI OUTPUT, AND FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED [USD 100] OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER. Some jurisdictions do not allow certain exclusions; those limits apply only to the extent permitted by law.

11. Termination

We may suspend or terminate your access at any time, with or without cause or notice. Sections 5, 7, 9, 10, 12, and 13 survive termination.

12. Governing law and disputes

These Terms are governed by the laws of [JURISDICTION]. Disputes shall be resolved in the courts of [VENUE] [or by binding arbitration under [RULES] — choose one with counsel; arbitration clauses and class-action waivers have jurisdiction-specific requirements].

13. Changes

We may update these Terms. Material changes will be announced on the Service. Continued use after changes take effect constitutes acceptance.
